Ankylosing Spondylitis and Social Security Disability - Winning Strategies

What is the best argument to win Social Security disability benefits if you have been diagnosed with ankylosing spondylitis?

You can use any or all of the three theories of disabilities to argue to SSA that you are disabled because of ankylosing spondylitis.

Listing 14.09 describes inflammatory arthritis and you would be at listing level if you spine has reached ankylosis (fixation) and the absence of flexibility intereres with activities of daily living, social functioning or completing tasks.

Fixation or fusion of spinal vertebrae are present in severe cases but you don’t need full ankylosis to win disability. You can argue that the joint inflammation, loss of flexibility and medication side effects have so reduced your capacity to function at work that you would be disabled under SSA’s rules (the functional capacity argument).

You can also use a grid rule argument if you meet the age, education and work background requirements because ankylosing spondylitis does cause physical capacity limitations.

In my office, I focus on the symptoms described by my client, objective evidence in the form of MRIs or CT scans showing the progress and extent of this inflammatory disease, and I will look at work records to document the decline in my client’s capacity to function.

I also find that because #ankylosingspondylitis changes cannot be reversed, most disability judges recognize that a claimant’s vocational capacity will not improve over time. #inflammatoryarthritis #spinalfusionanddisability
